Terms of Service

These terms are between Deep End Marketing ("Deep End", "we") and the pool builder that uses See Your Backyard ("you"). If you have a signed agreement or order with Deep End, it sets your fees and term, and it wins if it disagrees with these terms.

The service

See Your Backyard gives you a concept rendering tool for homeowners on your own web address, a portal to manage your prices, leads and settings, and delivery of leads to your email and your customer relationship software.

Accounts

Accounts are by invitation. You are responsible for the people you invite and for keeping logins private. Tell us straight away if you think a login has been misused.

Your content and your leads

You own your prices, photos, logos and other content, and you let us use them to run your tool. The homeowner leads your tool collects are yours. We handle them only to provide the service to you, as our Privacy Policy explains, and we do not sell them or give them to other builders.

Your responsibilities

  • Keep your prices, license number, financing details and any claims shown to homeowners accurate and lawful.
  • Contact homeowners lawfully. You are responsible for following the laws on calls, text messages and email, including the Telephone Consumer Protection Act, Do Not Call rules, the CAN-SPAM Act and state laws, and for honoring every request to stop.
  • Have your own privacy policy for homeowner information once it is in your own systems, and handle homeowners' requests about it.
  • Remember that concept renderings are illustrations and budget ranges are estimates. What you promise a homeowner is up to you.

Fair use

Do not use the service to break the law, to send unwanted messages, or to try to break into or overload it. We may set reasonable limits, such as a daily number of concept renderings, to keep the service working for everyone.

Fees

Fees are as set in your agreement or order with Deep End.

Availability and changes

We work to keep the service running, but we cannot promise it will never be interrupted. We improve the service over time, and may change or stop features. We will tell you before any change that takes away something important you rely on.

Ending the service

Either side may end the service as your agreement allows. We may suspend an account that breaks these terms or puts others at risk. When the service ends, we will give you a copy of your leads on request.

No guarantee and limits on liability

The service is provided as it is, without warranties beyond those the law requires. As far as the law allows, Deep End is not liable for lost profits or indirect losses, and our total liability is limited to the fees you paid in the 12 months before the claim.

You will cover Deep End's losses from claims about how you contact homeowners or about content you provide.
